Your protected health information (PHI) is something healthcare providers are required to keep safe. But what exactly does that mean for you, as a client or caregiver? Here are answers to some key questions about your PHI and how you can protect it. 

What Must Healthcare Providers Do to Keep Your PHI Safe?
Healthcare providers must follow strict rules under the Health Insurance Portability and Accountability Act (HIPAA) to ensure your PHI is protected. This includes implementing safeguards like encrypting data, limiting access to only those who need it, and conducting regular audits to ensure compliance. They also must train their staff on how to handle PHI properly, so your information stays confidential. 

How Can You Protect Your PHI?
While healthcare providers have an important role, you also have steps you can take to keep your PHI safe: 

  • Know who has access: Ensure you understand who is authorized to see your PHI, whether it’s a family member, caregiver, or healthcare provider. 
  • Use secure communication methods: When discussing your health information, use encrypted email or healthcare portals. 
  • Monitor your records: Regularly review your medical records for any inaccuracies or unauthorized access. 

What Should You Do If Your PHI Is Not Protected?
If you believe your rights to privacy are being denied or your PHI isn’t being kept secure, there are steps you can take: 

  • Contact the provider: Speak to the healthcare provider directly about your concerns. It may be a misunderstanding that can be resolved quickly. 
  • File a complaint: If the issue isn’t addressed, you can file a complaint with the U.S. Department of Health and Human Services (HHS) Office for Civil Rights. 
  • Seek legal advice: In some cases, consulting with a lawyer who specializes in healthcare law may be necessary.
